Tambuwa — Terms & Conditions

1. Introduction

Welcome to Tambuwa (the “Service”), a civic technology platform that helps individuals capture and manage contact details to support coordination, and mobilization. By accessing or using the Service, you agree to be bound by these Terms and Conditions (“Terms”).

2. Eligibility

• You must be at least 18 years old from within Macalder/Kanyarwanda ward or have interest in Macalder/Kanyarwanda ward development activities.
• You must provide accurate and truthful information during registration and use of the Service.
• You must comply with all applicable laws of the Republic of Kenya.

3. User Responsibilities

• Keep your account credentials confidential and secure.
• Provide accurate, up-to-date information and promptly correct inaccuracies.
• Use the Service for lawful purposes only and respect others’ rights.
• Notify us immediately of any unauthorized access or suspected breach.

4. Data Protection & Privacy

Tambua is committed to protecting your privacy in accordance with the Kenya Data Protection Act, 2019 and applicable regulations. We collect and process personal non-sensitive data such as fullname / nicknames , mobile number and polling station strictly for identification, civic participation, and mobilization purposes, or other purposes disclosed at collection.

• We do not sell or rent your personal data to third parties.
• We may share data with authorized bodies only where required or permitted by law.
• We implement appropriate organizational and technical measures to safeguard personal data.
• Your use of the Service constitutes consent to collection and processing as described and further detailed in our Privacy Policy.

5. Prohibited Use

• Engaging in illegal, fraudulent, or harmful activities.

We strive for reliable, continuous service but do not guarantee uninterrupted access. We may suspend, restrict, or terminate access for maintenance, security, operational, or legal reasons without prior notice.

8. Limitation of Liability

To the maximum extent permitted by law, Tambua shall not be liable for indirect, incidental, special, consequential, or punitive damages, or for unauthorized access resulting from events beyond our reasonable control, or for errors, interruptions, or delays in the Service.

9. Termination

We may suspend or terminate your account or access if you violate these Terms or applicable laws. Upon termination, your right to use the Service ceases immediately, subject to any rights that must continue by law.

10. Governing Law

These Terms are governed by the laws of the Republic of Kenya. You agree to the exclusive jurisdiction of Kenyan courts for any dispute arising out of or relating to these Terms or the Service.

We may update these Terms from time to time. Changes take effect upon posting the updated Terms on this page, indicated by the “Last Updated” date above. Continued use after changes constitutes acceptance.
